Going to get a new phone today and I was wondering which of the 2 is better? What do you guys think? I will be getting one or the other.
Droid Maxx or Moto X? Which should i get?

It's really a personal preference, so I would say if you can, go hold them. Feel is probably one of the most important aspects. As Stewie metnioned, the OS is close enough. I don't have a Maxx, but from what I understand the battery life is awesome. On my X, with moderate use, in a 16 hour day, I end up with around 50% left. (I charge every night ). If you are buying off contract, I would have a hard time justifying the price diff.

Would It be possible to get active display and touchless control while on a different rom? I was considering the same thing as sluicebox but dev editions. If I were to switch to CM for instance, would touchless control and active still be possible from moto?
Finally one last question. I know Lenovo bought out moto, so does anyone expect a phone from them in the next 6 months?

Nope. Those functions will on a stock Moto rom

I have the Maxx and love the battery. Almost 2 days of usage without having to charge. If I could do it again, I'd buy a DE version. KitKat pretty much hosed up root on the Maxx, not sure about the X. I'm glad I bought mine before 4.4.2 came out so I could keep root through the process.
